  2. Court fees
  3. Publication of notice fees
  4. Accounting fees 
  5. Appraisal fees
  6. Recording fees for deeds.

The fees for the probate lawyer are paid by the estate and not by the executor or administrator. Some probate lawyers charge an hourly rate. This varies by location and by how specialized or experienced the attorney is. The more experience, the higher the rate. Some probate lawyers charge a flat fee. They quote a price for handling the case. 

Usually, the probate lawyer requests a percentage based on the estate’s gross value. For example, some states, such as California, regulate probate lawyer’s fees through the statute. 

This also forbade probate lawyers from charging more than a certain percentage of the gross estate’s value. Sometimes, it is found that the fees can appear to be unreasonable to some clients, especially for those clients who have larger value estates. This is because the percentage does not come from the worth minus debts, such as mortgages on properties but from the gross value.

During probating, the lawyer’s pay includes court fees based on the assets owned and the subject matter of the petition. The cost varies from place to place. For example, it is 2% to 7.5% in Maharashtra, depending on the value mentioned under the Schedule, subject to a maximum of Rs 75,000.   

Cost of Probate lawyer in the US-

Probation is a process that consumes a lot of time and effort for a lawyer dealing with a case. In addition, the fees can differ from state to state. The Uniform Probate Code (UPC) is adopted in most states of the US. 

The UPC was established to streamline the probate process. This makes probate administration simpler and less expensive. In addition, the States have utilized this code to standardize the probate process across the states in the US. 

It depends on the area of the estates, which means smaller estates lead to a more straightforward probate process. Generally, in the US, an estate with a property value of less than $100,000 is a smaller estate. Thus, the lawyer dealing with small estates depends on state law. If your estate meets specific requirements, the state may allow you to skip the entire probate process.

Let’s take a case, for example, a probate lawyer dealing with an estate in Texas, a Small Estate Affidavit not including the homestead property or other exempt property and has filed to transfer property to a decedent’s heirs if the value of the estate is less than $75,000.00. 

In California, probate courts allow a decedent to transfer their assets to their heirs and avoid a formal probate proceeding if the total value of their estate is less than $166,250.00 as of January 1, 2020.


The probate is crucial as society’s property is bequeathed to an individual who wants to occupy it—the cost of a probate lawyer. As per the estate worth, the probate fees vary widely from area to region, the same for the probate lawyer, although they typically range from 3% to 7%.

As the price of the land dealing with the client grows, the fees tend to go considerably higher. The client should always know the fee structure and the correct services they provide. They must also check for the probate lawyer’s professionalism and experience. Therefore, the probate lawyer expenses are likely higher depending on the location and complexity of the case involved.
